Disclaimer

Email Fire Domain is a software tool that automates warmup-style sending behavior (including gradual ramps, seed-style engagement patterns, spam/open tracking indicators, and AI-assisted short replies). It is not Google, Microsoft, an ISP, an email service provider guarantee program, or a law firm. It is not a guarantee of any deliverability or business outcome. Support: support@emailfiredomain.com.
This Disclaimer applies to https://emailfiredomain.com and all related materials, dashboards, metrics, marketing copy, and documentation (the "Service") operated by FiveToClose. Email Fire Domain is another product of the brand FiveToClose.cloud. By using the Service you also agree to our Terms of Service and Privacy Policy.
1. Educational and informational purposes
All guidance, ramp schedules, health scores, event logs, and recommendations are provided for general educational and operational information only. Nothing on the Service is professional legal, compliance, security, or deliverability advice tailored to your situation. Consult qualified professionals for your jurisdiction, industry, and infrastructure.
2. No guarantee of inbox placement or reputation
We do not guarantee that messages will land in the primary inbox, avoid spam or promotions folders, pass spam filters, improve Postmaster tools scores, raise domain or IP reputation, or remain unblocked. Mailbox providers use proprietary, changing algorithms. Prior domain history, content, authentication (SPF/DKIM/DMARC), list quality, complaint rates, and volume all matter — most of which we do not control.
Dashboard "health," open, spam, and reply figures may include simulated seed-network metrics, partial signals, or estimates. They are not promises of future performance and may not match Google Postmaster, Microsoft SNDS, or third-party inbox placement tests.
3. No guarantee of traffic, sales, or list performance
We make no promises regarding opens on your marketing campaigns, click-through rates, unsubscribes, spam complaints, revenue, affiliate commissions, or subscriber growth. Warmup prepares sending behavior; it does not sell your offer for you.
4. Hands-off automation still has limits
"Hands-off" means the Service is designed to run scheduled jobs after you connect and pay — not that outcomes are automatic success. Carriers may throttle, challenge, or block mail regardless of warmup. Invalid credentials, DNS misconfiguration, provider outages, or AI/provider failures may interrupt automation. You remain responsible for monitoring your domains and mail accounts.
5. Seed networks, PVA risk, and honesty
Industry warmup methods often involve seed lists or engagement networks. Building or buying large phone-verified account (PVA) pools can be unreliable, short-lived, or fraudulent when sourced poorly. Our Service may use simulated engagement, proprietary seed logic, and/or third-party infrastructure depending on configuration and version. We do not claim ownership of any third party's personal marketing lists, and we do not require you to place your protected "clicker" assets into the system.
6. AI-generated text
AI-assisted outbound and reply text is automated and may be imperfect, generic, or inappropriate for regulated industries. You should not rely on AI output as compliance-approved copy. Filters may still treat AI-like language as low quality even when we attempt to humanize phrasing (e.g. avoiding em dashes).
7. Your legal and compliance obligations
You alone are responsible for ensuring that your email practices comply with:
- CAN-SPAM, CASL, GDPR, UK GDPR, CCPA/CPRA, and other applicable laws
- Consent and record-keeping requirements for marketing mail
- Google, Microsoft, Yahoo, and ESP acceptable-use policies
- Truth-in-advertising and industry-specific rules (health, finance, crypto, etc.)
Misuse of the Service for spam or abuse may result in termination and does not create liability for us beyond what the Terms allow.
8. Third-party services
Authentication (Google), payments (Stripe), AI APIs, hosting, DNS, and mailbox providers are third parties. We are not affiliated with or endorsed by Google, Microsoft, Stripe, OpenAI, Anthropic, xAI, or other named brands unless explicitly stated. Their outages, policy changes, pricing changes, or enforcement actions are outside our control.
9. No professional relationship
Use of the Service does not create an attorney-client, fiduciary, partnership, or employment relationship. Testimonials, examples, or case-style marketing language (if any) are illustrative and not typical results.
10. Limitation reminder
To the fullest extent permitted by law, FiveToClose and Email Fire Domain disclaim liability for losses arising from use of or inability to use the Service, including lost mail, blocked domains, lost profits, and data issues. See the liability cap and indemnity in our Terms of Service.
11. Changes
We may update this Disclaimer at any time. The "Last updated" date will change when we do. Continued use constitutes acceptance of the updated Disclaimer.
